We use special words in this document to assist your understanding of its content; the following expressions shall have the meanings set out opposite to them:

Doctor shall mean any of the medical or other practitioners (including clinics or other organisations providing medical or medically related services)

  • whose details are available from London Colorectal Group and
  • with whom interaction is available to the User by the methods of communication made available by us

and where relevant includes the Doctor’s partners, associates, employees and representatives

Services shall mean

  • those services, data and information found within London Colorectal Group or available from any database accessed from London Colorectal Group or by virtue of any other reference from London Colorectal Group online and

T&Cs, this document shall mean these terms and conditions

Erroneous input from the User may produce inaccurate information being passed to the Doctor. You are ultimately responsible for the information you provide.

You must use the Services or any part of them:

  • only by you and for your needs
  • following the instructions provided by the relevant Service
  • in an honest and responsible fashion having reasonable regard to the implications of providing false data or information
  • ensuring that you have the necessary and compliant computer tools and software to connect to the internet
  • accurately, with due care and taking proper care over access codes and passwords.

If you have any doubts about your immediate health condition either arising from the output of the Services or otherwise you should seek the immediate assistance of a health professional. If you believe that you have a medical emergency, you should immediately contact the emergency services.

Section C: Actions that you Must Avoid

You must not in relation to the Services and/or London Colorectal Group online or any part of them:

 

  • copy, reproduce, modify, distribute, transmit or alter any element of them;
  • publish, display or represent any of them as yours or as belonging to anyone other than the rightful owner;
  • conduct any other activity that could infringe any valid rights of London Colorectal Group or other suppliers of products and/or services offered through them;
  • extract the source code of them in whole or in part, including reverse engineering, translation, the creation of derivative versions or other activities developing or exploiting them;

    • for commercial purposes, or
    • to breach the intellectual property of London Colorectal Group or any third party (including any trademarks, brands, trade names or distinctive signs)

  • breach any law or regulation effective within the jurisdiction where you have registered with us or from where you are accessing them

If you or anyone acting on your behalf or as instructed by you breach the terms of this Section C or any other pertinent terms of the T&Cs then

  • you, or such other persons as are appropriate, shall be responsible for any loss or damages directly incurred by London Colorectal Group or any third party involved in providing the Services.
  • London Colorectal Group shall be entitled to immediately withdraw the Services from you or any other relevant person without notice.

You must not use any of the Services in a manner which may bring distress or harm to any party and in particular you should not use and form of aggressive or hateful speech or language.

Section D: Understanding the Implications for You in using the Services

In relation to the User accessing the Services and London Colorectal Group online are not responsible for

  • any misuse or damage caused to you as a result of the loss of your user code/password and/or as a result of its use by a third party
  • any damages that may arise from interference, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operation of the Services
  • damage caused to computer equipment of Users including any damage caused by external sources either intentionally or unintentionally.

London Colorectal Group takes all reasonable precautions to protect User information and confidentiality but cannot guarantee that security or malicious attacks by third parties will be unsuccessful.

The initial access to London Colorectal Group by the User or anyone authorised by the User represents acceptance of these T&Cs, the Privacy Policy and the Cookies Policy.

You may access the Services because of your relationship with one of our partners (Partners). If you have a relationship with one of our Partners, some additional terms may apply to your use of the Services, which will be provided to you by the Partner on your initial access to the Services and from time to time.

Considerations for the User

Choosing medical advisers is an important decision that should not be based solely on advertising or advertisements within the Services.

The choice of a Doctor via London Colorectal Group and the Services does not imply that a cure to any condition is available.

The information presented on London Colorectal Group online and the Services does not constitute medical advice, nor a referral medical service. 

London Colorectal Group is not responsible for the conditions, limitations or fees arising when the User and the Doctor engage with each other.

The User accepts and acknowledges that failure to comply with any term, circumstance or condition imposed by the Doctor may result in cancellation of the Doctor’s service.

Section E: Miscellaneous Matters

In the event of any conflict between these T&Cs with any previous version unless otherwise stated the provisions of these T&Cs shall prevail.

The Services and other material includes content that is accessed through links that send the User to other pages and Internet portals (Links).  In no case does the inclusion of Links entails the existence of agreements nor the recommendation, promotion or identification of London Colorectal Group  with the websites or persons to which such links provide direction, with said contents or services.

London Colorectal Group reserves the right to make modifications to these T&Cs when it deems appropriate, or as may be required by law which modifications will be deemed to be accepted by the User on their next access to the Services or London Colorectal Group after the date of the modifications. In the event that substantive changes are made to these T&Cs, London Colorectal Group will use reasonable endeavours to inform the Users of the changes made. However, it is the User's responsibility to periodically verify the existence of updates to these T&Cs .

All notices and communications by London Colorectal Group to the User shall be made either by email to the email address last recorded by the User utilising the facility within the Services or by recorded or guaranteed post at the address last recorded by the User utilising the facility within the Services.

Email communications are deemed to be received within one working day and communications by post within two working days.

These T&Cs are governed by the Laws of England and both London Colorectal Group and the User agree to submit to the exclusive jurisdiction of the English Courts.

Section F: Payments

London Colorectal Group may requests payments from the User on behalf of the Doctor as part of London Colorectal Group online or in respect of a service provided directly by London Colorectal Group.

London Colorectal Group only accept payments made by such payment providers as shall be identified within the relevant part of the Services. 

For your convenience, and to protect information relating to your payment, all payments are made either by :

Cheque made payable to “London Colorectal Group” and sent to Suite 305 Emblem House, London Bridge Hospital, 27 Tooley Street, London SE1 2PR marking the back of any cheque with the relevant invoice number;

By credit or debit card by calling our office on 0207 234 2833; or 

By bank transfer – details available by calling 0207 234 2833.

London Colorectal Group will comply with all of lawful requirements imposed by the payment provider and statute in administering the payments.

Section G: Privacy Policy

By accessing London Colorectal Group or using the Services you acknowledge your acceptance of this Privacy Policy and agree to its terms. If you do not wish to accept this Privacy Policy, you should immediately exit London Colorectal Group online and refrain from using the Services.

  • an imperative to report a matter contained within User Information to the police or other relevant authority. This is where London Colorectal Group reasonably believe a serious crime has been or is about to be committed or where London Colorectal Group reasonably believe that an individual is in serious danger.
  • The express consent of the User

The User shall have the following rights in relation to the protection of their data. The User may:

 

  • exercise their rights of access, rectification, cancellation and choice on the use of personal data under the Data Protection legislation and all other effective laws and regulations pertaining to the personal data of the User by contacting London Colorectal Group and according with the reasonable and lawful requirements of London Colorectal Group in accordance with such requests

Information That May Be Collected and Used

Always excepting the the content of London Colorectal Group, while London Colorectal Group may gather User Information primarily to share with Doctors for the purposes of health related matters., London Colorectal Group may also use unidentifiable, non-personal information collected from London Colorectal Group online for statistical analysis, improvement of the Services/London Colorectal Group online.

London Colorectal Group may use the User Information to

  • Respond to queries or requests for information that may be made by the user;
  • Billing and collection of services.
  • to communicate information about services, products and activities of London Colorectal Group to the user

London Colorectal Group obtains personal data provided by the User through the following means:

  • by visiting or using the Services
  • through the user registration or User input in respect of the Servic
  • cookies and similar technologies

London Colorectal Gropu may disclose your personal information to a third party as part of the sale of London Colorectal Group assets, or as part of the process of changing control of the company. The user or patient hereby expressly authorises London Colorectal Group to publish (anonymously, only the initials will be used) the comments made or the online assessments for the care received from the doctor by London Colorectal Group on social media, on the London Colorectal Group website, on doctor’s websites, or in any other media that London Colorectal Group appears in.

Section H: London Colorectal Groups’ Liability

London Colorectal Group and all of its content are provided on an ‘as is’ and ‘as available’ basis. This means that there are no guarantees, conditions or warranties (express or implied) offered by London Colorectal Group that London Colorectal Group online will be:

  • complete, accurate, up to date or error-free; London Colorectal Group will reasonably endeavour to correct any possible error or omission as soon as possible

  • articles published without the collaboration of a doctor which are written after medical research by our content editors according to public sources on the web
  • for the information published on the personal pages of London Colorectal Group members which is the responsibility of the Doctors and healthcare professionals who are responsible for their accuracy and compliant with any law or regulation.
  • for the scientific publications which are provided by specialist physicians, whose names are indicated in the title of the article.

London Colorectal Group together with its partners, collaborators, employees and representatives are not responsible for any errors or omissions within the Services or other content that can be accessed through it.

London Colorectal Group together with its partners, employees, employees and representatives are not responsible for any damages incurred by the User or any other party arising from the use of the Services, or for any action taken on the basis of the information provided in the Services.
